Full policy
Set out below are terms and conditions that apply to enrolment in our public
education courses or registration to attend our events.
Last updated – June 2022
These terms and conditions contain important information about your enrolment or
registration (as the case may be), including our cancellation policy, what happens if we
need to change or cancel a course or event and our limitation of liability.
Please scroll to the applicable terms and conditions for your purchase and read carefully to
ensure you are fully aware of your rights and obligations under the applicable terms and
conditions.
Minone Pty Ltd public course enrolment terms and conditions
Please read the following carefully to ensure you are fully aware of your rights and
obligations under these Terms and Conditions.
Participant enrolment
Enrolment is subject to receipt of your payment and our confirmation of availability. You
must pay any invoice within 7 days of receipt and payment must be received in full before
we provide course materials and course commencement.
If you have enrolled online within the current period (not for a future course) you will be
provided with immediate access to course materials subject to receipt of payment.
Member course fees
Member course fees are only available to Minone Pty Ltd Members.
Enrolment changes by you
If for any reason you are no longer able to attend the course on the date you have enrolled
for, you may give us a request in writing to cancel, transfer or substitute your
enrolment. Please note that a charge may apply. Further details are set out below.
We deduct any applicable charge from any refund due to you. In addition, any of our
materials already provided to you must be returned before we remit any refund and/or
confirm a transfer or substitution.
If for any reason you do not provide us with the required notice or do not attend the
course, no refunds are payable and no changes to your enrolment will be accepted. We
may review this policy in the case of special circumstances where sufficient evidence is
provided.
For all online course changes including cancellation, transfer or substitutions are NOT
available after you have accessed the course in Moodle.
Cancellation
You may cancel your enrolment altogether. However, you may consider transferring to
another course option or substituting another eligible participant as further explained
below.
Transfer
If you wish to transfer to a different course date; to a different course altogether; or to a
different course format, you may request to transfer your enrolment. Only one transfer is
permitted per enrolment and the alternative option must be within 12 months of your
original course.
A transfer request is subject to availability of the alternative date, course or format in your
request and may incur additional fees. You will be contacted to confirm your new event, or
we will place you on a waitlist if the alternative option is not available at the time of your
request.
If you transfer to a different course or different delivery format any difference in the course
fee will be payable by you or refunded by us as applicable and subject to any charge as
explained below. The new enrolment course dates will apply.
Any further transfer request will be treated as a cancellation and will incur a 100%
cancellation charge.
Substitution
You may request to substitute another person to enrol in your place. Only one substitution
is permitted per enrolment. The proposed substitute must review and confirm to us that
they meet the enrolment criteria applicable for that course before we will accept the
substitution.
If the substitution involves a participant change from an Minone Pty Ltd Member to a non-
member (or vice versa), any difference in the course fee will be payable by you or
refunded by us as applicable and subject to any charge as explained below.
Any further substitution request by you or the substitute will be treated as a cancellation
and will incur a 100% cancellation charge.
*Please note where a transfer of enrolments requires new notes to be issued these will be
charged at the applicable fee at the time of transfer).
We exclude weekends, public holidays and the first day of a course (course start date)
when calculating how many days’ notice you have provided for any requested changes to
your enrolment.
Enrolment changes by us
If we are required to cancel or vary course dates or locations due to circumstances outside
our control, including insufficient course enrolments, you will be offered a full refund of the
total course fee, or a transfer or substitution, which will not be treated as a request by you
for the limits specified above. However, unless required by an applicable law, we will not
be responsible for any airfare, hotel or any other direct or indirect costs or losses incurred
by participants in any circumstances and you are strongly encouraged to take this into
account when booking travel arrangements.
Where access to online courses is affected by Minone Pty Ltd’s systems outage (website
and Moodle) which is greater than forty eight hours (or multiple instances of outages), the
course access period may be extended by the amount of time that the site has not been
available.
Privacy
By registering, you acknowledge that you have read and understood the Minone Privacy
policy as amended from time to time, and agree with and consent to the practices
described in that Privacy Policy.
When you register for a course we will ask you to provide us with information that
personally identifies you or allows us to contact you (Personal Information) in connection
with the operation of the course . Minone Pty Ltd agrees that it will only collect, store,
distribute and communicate Personal Information which is provided to Minone Pty Ltd by
you, or is otherwise collected by Minone Pty Ltd as a result of your access to, and use of
the course material in accordance with the Minone Privacy Policy.
On the commencement date of a course the Minone Pty Ltd will share your name and
preferred contact email address with your fellow Cohort members to facilitate valuable
peer to peer connection. If you do not consent to sharing your contact email address
please contact your Minone to discuss your concerns a minimum of 3 days prior to the
Online Education course commencement date.
Disclaimer
Regarding Information Technology and Communications (ITC), Minone Pty Ltd confirms it
will take reasonable steps to utilise quality ITC services and processes, including provision
of identified mitigants in the event of an error, for example the provision of alternate
internet service for facilitators in the event of poor internet coverage. Notwithstanding this,
the Minone Pty Ltd does not guarantee that online facilitation will be performed error-free
or uninterrupted, or that Minone Pty Ltd will correct all online facilitation errors. You
acknowledge that Minone Pty Ltd does not control the transfer of data over
communications facilities, including the internet, and that the online facilitation may be
subject to limitations, delays, and other problems inherent in the use of such
communications facilities.
Accordingly, Minone Pty Ltd is not responsible for any delays, delivery failures, recording
failures or other damage resulting from such problems. To the extent not prohibited by law,
there are no express or implied warranties or conditions including for systems, networks or
environments or satisfactory quality.
Use of material
Materials and content made available to you as a course participant are subject to
copyright and other rights owned by Minone Pty Ltd or its licensors. All such material is
protected by the Copyright Act 1968 (Cth) and other international copyright and intellectual
property laws.
You may only use the materials and content for your own private non-commercial use. No
part of the materials and content covered by copyright should be copied, reproduced,
modified, distributed, transmitted, or republished in any form or by any means without the
written permission of the Minone Pty Ltd.
International participants
For participants who enrol in a course outside Australia, payment of the applicable course
fee must be made free and clear of any tax, withholding or other amount and we shall be
entitled to recover from you any such amount deducted.
General
These Terms and Conditions are in addition to your rights under the Australian Consumer
Law.
From time to time, we may update these Terms and Conditions. The updated Terms and
Conditions will apply to all enrolments from the time of posting on our website onwards.
Minone Pty Ltd Event Registration Terms & Conditions
Please read the following carefully to ensure you are fully aware of your rights and
obligations under these Terms and Conditions.
There are two types of Minone Pty Ltd Events, namely:
Online: The event takes place via an online delivery eg course exercises, lessons and
tests– participation is undertaken via the users Moodle portal
Online: The event takes place via an online delivery eg Webinar– participation is
undertaken by joining the event online via a link provided by the Minone Pty Ltd.
The respective Change of Event Registration Timings and Charges* for each type of
Minone Pty Ltd Event is outlined in a table below.
Event registrations
Registration is subject to receipt of your payment and our confirmation of availability. You
must pay any invoice within 7 days of receipt and payment must be received in full before
the event.
Member registration costs
Member registration costs are only available to Minone Pty Ltd Members. Non-members
wishing to join the Minone Pty Ltd and be eligible for the Member registration cost should
complete the Membership application form online.
Registrations changes by you
If for any reason you are no longer able to attend the event for which you have registered,
you may give us a request in writing to cancel or substitute your registration. Please note
that a charge may apply. Further details are set out below.

and other rights owned by Minone Pty Ltd or its licensors. All such material is protected by
the Copyright Act 1968 (Cth) and other international copyright and intellectual property
laws.
You may only use the materials and content for your own private non-commercial use. No
part of the materials and content covered by copyright should be copied, reproduced,
modified, distributed, transmitted, or republished in any form or by any means without the
written permission of the Minone Pty Ltd.
International participants
For participants who register for an event outside Australia, payment of the applicable
registration cost must be made free and clear of any tax, withholding or other amount and
we shall be entitled to recover from you any such amount deducted.
General
These Terms and Conditions are in addition to your rights under the Australian Consumer

From time to time, we may update these Terms and Conditions. The updated Terms and

Minone Pty Ltd webinar terms and conditions
Set out below are the terms and conditions that apply to enrolment and participation in an
Minone Pty Ltd Webinar (Terms and Conditions).
Please read the following carefully to ensure you are fully aware of your rights and
obligations under these Terms and Conditions.
Webinar registrations
The Minone Pty Ltd provides interactive seminars conducted over the internet (Webinars).
Registration for a Webinar is subject to receipt of your payment and our confirmation of
availability. You must pay any tax invoice from the Minone Pty Ltd within 7 days of receipt
and payment must be received in full before the Webinar (whichever is earlier).
Registration is only available to individuals. The purchase of a Webinar is for use by the
registered participant only and registration information should not be forwarded on to third
parties; doing so may hinder your own access, as Webinar entry is by prior registration
only.
Member prices
Member prices are only available to Minone Pty Ltd Members. Non-members wishing to
join the Minone Pty Ltd and be eligible for the Member price may apply for membership
online .
International participants
For participants who register for a Webinar outside Australia, payment of the applicable
registration cost must be made free and clear of any tax, withholding or other amount and
we shall be entitled to recover from you any such amount deducted.
Changes by you
If for any reason you are no longer able to attend the Webinar for which you have
registered, you may submit a request to cancel or transfer your registration. This request
must be submitted via your MySite account or in writing to your membership partner within
the required notice period set out below.
If for any reason you do not provide us with the required notice or do not attend the
Webinar, no refunds are payable and no changes to your registration will be accepted.
All webinar cancellation or transfer requests will be subject to availability of the alternate
webinar requested. Any difference in price will be payable by you or refunded by us as
applicable and subject to any condition as set out below.
Cancellation and Transfer conditions
Live Webinar:
Cancellation or transfer with a full refund (if applicable), is available any time prior to the
day of the Webinar.
Cancellation or refund is not permitted on the day of the webinar.
Recorded Webinar:
Cancellation or transfer with a full refund (if applicable) is available any time within 30 days
of the purchase date and you have not commenced viewing the recording,
Cancellation or refund is not permitted on the day of the webinar.
We may review this policy in the case of special circumstances where sufficient evidence
is provided at our discretion.
Changes by us
If we are required to cancel a webinar you will be offered a full refund of the total
registration cost or if we are required to vary Webinar dates due to circumstances outside
our control your registration will be transferred to the new date and you will be duly
notified. If you are unable to attend the new date you are entitled to cancel your
registration and receive a full refund of the total registration cost.
Subject to any applicable law, the Minone Pty Ltd will not be responsible for any direct or
indirect costs or losses incurred in any circumstances.
The Minone Pty Ltd reserves the right to accept registration, change facilitators, Webinar
content, and dates, as necessary.
Privacy
By registering, you acknowledge that you have read and understood the Minone Privacy
Policy and agree with and consent to the practices described in that Privacy Policy.
In connection with the operation of the Webinar we will ask you to provide us with
information that personally identifies you or allows us to contact you (Personal Information)
when you register for the Webinar.
Webinar recording notice
The Webinar includes a feature that allows audio and any documents or other materials
exchanged or viewed during the session to be recorded. By attending an Minone Pty Ltd
Webinar, you acknowledge that any contribution may be recorded, and consent to such
activities and the future use, including the sale, by the Minone Pty Ltd of any recordings. If
you do not consent to the recording, please contact Minone to discuss your concerns at
least 14 calendar days prior to the Webinar date.
Recorded Webinar Conditions
The expiration date of a recorded Webinar will be advised to you at the time of your
purchase and within 48 hours of the expiration date the hyperlink for the recorded Webinar
will cease to function. You may view a recorded Webinar up to a maximum of 2 times.
Where the percentage of a recorded Webinar viewed is greater than 0 percent, this will
qualify as 1 viewing. The Minone Pty Ltd will use reasonable endeavours to upload the
recorded Webinar within 48 hours of the live Webinar broadcast.
Webinar participation and behaviour
Webinar participation may require you to configure your software settings on your web-
device upon first use or require you to download the software for your operating system.
You can access the Webinar from your smartphone, iPad or tablet.
Any views expressed by you during a Webinar must be your own. During a Webinar you
must not behave in a manner or distribute any material which is abusive, defamatory,
obscene, contrary to law or to the rights of any person. The Minone Pty Ltd may remove
you and any offending material from a Webinar and decline your future participation in
Minone Pty Ltd Webinars for any behaviour which the Minone Pty Ltd considers
contravenes this clause.
Use of material
Materials, content made available to you as a participant and any Webinar recording are
subject to copyright and other rights owned by Minone Pty Ltd or its licensors. All such
material is protected by the Copyright Act 1968 (Cth) and other international copyright and
intellectual property laws.

Ltd, us or we) operates this Website and provides the Courses and other Services
Legal agreement: These User Terms (Terms), our Policies and other legal terms notified
to you when you opened your Account are a legal agreement between users of this
Website (you) and Minone Pty Ltd. The Terms cover your access to and use of this
Website and the supply and use of Minone Pty Ltd Materials and Services via the Website
including the Courses.
Acceptance: By accessing or using this Website you acknowledge that you have read
and agree to be bound by these Terms and our Policies. If you do not agree to these
Terms or our Policies, please do not use this Website.

Ltd and its Personnel and current Participants, Facilitators and Markers are permitted to

Application of Terms: These Terms apply to you if you are a Participant, a Facilitator or a
Marker or if you otherwise access this Website. Different parts of these Terms apply to
Participants, Facilitators and Markers respectively while some parts apply to all users of
this Website. Please read these Terms accordingly.

Usernames and Passwords: Your Account and the Website are accessible via the
Minone Pty Ltd Login by entering your unique username and password. You are
responsible to prevent unauthorised disclosure of or access to your username and

Connection and data charges: Your telecommunications service provider may impose a
connection or data charge for all Minone Pty Ltd Materials and other material such as
Participant Submissions, Facilitator guides (Facilitators only) and Marker Responses

Applications, as applicable. You are responsible to pay any applicable connection or data
charges.
Intellectual property: Minone Pty Ltd Materials and content displayed on or comprised by

exceptions displayed on the Website. You must not seek to circumvent or disable any
technological protection measures contained within the Website, the Minone Pty Ltd

Plagiarism and Auditing: Without limiting the previous paragraph, you warrant that all
Participant Submissions you prepare and lodge will be your own, original work.
Participants agree that by taking a Course your Participant Submissions may be submitted
for textual similarity review to Turnitin.com for the detection of plagiarism using Turnitin. All
Participant Submissions will be included as source documents in the Turnitin.com
reference database solely for the purpose of detecting plagiarism of such Participant
Submissions. Use of the Turnitin.com service is subject to the Usage Policy posted on the
Turnitin.com site. Minone Pty Ltd may from time to time contact Participants after they
have submitted a Participant Submission and ask them to outline the approach they
followed in structuring and presenting their Participant Submission. Minone Pty Ltd, in
consultation with its Markers, is solely responsible for decisions in relation to originality of
work and plagiarism. The Minone Pty Ltd may from time to time carry out Audits. If, as a
result of any Audit, the Minone Pty Ltd determines that a Participant has not fulfilled
Course requirements, the Minone Pty Ltd may apply penalties in accordance with its
Policies.
Information on the Website: Information on this Website and in the Minone Pty Ltd
Materials may or may not change from time to time. It is not promised or guaranteed to be
correct, current, or complete. This Website and the Minone Pty Ltd Materials may contain
technical inaccuracies or typographical errors. Minone Pty Ltd assumes no responsibility

make such communications and transactions and agree to receive electronic
communications from us at your own risk.
Technical requirements: Access to the Website and Services may only be available to
compatible devices which meet specific system or software requirements specified on the
Website from time to time. Minone Pty Ltd gives no warranty or guarantee that access to
or use of the Website or Services will be available to all devices and you are solely
responsible for ensuring that any device you use meets system, software or other

data you submit to Minone Pty Ltd is correct, current and complete; and (b) you own all
Intellectual Property Rights in the participant Submissions you post to the Website and
otherwise have the right to upload such materials to the Website.
Indemnity: You agree to indemnify, defend, release and hold harmless Minone Pty Ltd
and its Personnel from and against all Losses made by any person arising out of: (a) your
use of this Website or the Minone Pty Ltd Materials; (b) any violation of these Terms, any
terms and policies it incorporates by reference, the rights of another party or any
applicable law; (c) any Participant Submission you post to the Website; or (d) any activity
related to your Account by you or any other person accessing the Website using your
Account username or password.
Privacy: Your privacy is important to Minone Pty Ltd. Further information about the
collection and use of your personal information is contained in our Privacy Policy. By
accessing, browsing or using this Website or by supplying any information to Minone Pty
Ltd, you acknowledge that you have read and agree with the terms of our Privacy Policy.
Data analytics: Minone Pty Ltd may from time to time draw reports on Website usage to
provide analytics on learning behaviours and patterns. This may include log in, content
access, Participant Submissions and access to any other resources that are provided on
the Website. This usage information is generally not linked to an individual Participant
excluding in the case of providing learning support, but is collated and de-identified.
Cancellations and suspensions: You may cancel your Account at any time by giving us
14 days written notice. We may cancel or suspend your Account at any time immediately if
you breach these Terms (including our Privacy Policy). At our sole discretion, we may also:
(a) remove, block or refuse to post to the Website any Participant Submission; (b) cancel
or suspend your Account; (c) cancel or suspend your access to the Website; or (d) cancel
or suspend the operation of the Website in its entirety at any time.
Personal use only: We provide access to this Website to you individually and personally
while you are a Participant or solely in connection with you providing the Facilitation
Services or Marker Services, as applicable, if you are a current Facilitator or Marker,
respectively. Your right to use the Website and participate in the Courses, if applicable,
cannot be assigned to anyone else and you must not re-sell the services offered by our
Website to anyone else or make other commercial use of the Services or the Website
without our prior written consent.
Mediation: Any complaint, dispute or controversy arising in any way out of these Terms or
use of the Website may at our option be referred to mediation conducted by and in
accordance with the rules adopted by the Australian Commercial Disputes Centre.
Severance: If any part of these Terms is unlawful, void or for any reason unenforceable
then that provision is deemed to be severed from these Terms and does not affect the
validity and enforceability of any of the remaining provisions of these Terms.
Waiver: No failures to exercise and no delay in exercising on our part any right or privilege
under these Terms operates as a waiver thereof. A waiver by us of any breach of these
Terms does not prevent the subsequent enforcement of that provision and will not be
deemed to be a waiver of any subsequent breach of that or any other provision.
Entire agreement: These Terms and any other document they refer to constitute the
entire and only agreement between the parties in relation to its subject matter and replace
all prior agreements, arrangements or understanding of any nature made by the parties or
any of them whether oral or written.
Excusing events: We will be under no liability to you in respect of anything which may
constitute a breach of these Terms by us arising by reason of any event or circumstances
beyond our reasonable control.
Assignment: You are not allowed to assign, novate or sub-contract any of your rights and
obligations under these Terms. We may assign, novate or sub-contract any of our rights
and obligations under these Terms at our discretion.
Relationship: Nothing in these Terms creates or is intended to create any relationship of
agency, partnership, joint venture, employment or similar between the parties.
Applicable law: These Terms are governed by the law of Victoria, Australia. The parties
submit to the non-exclusive jurisdiction of the courts of Victoria and its appellate courts.
Definitions: For the purposes of these Terms, the following terms have the specified
meanings:
Account means a user account authorised by Minone Pty Ltd and created by a User as
part of the registration process for, in the case of a Participant, enrolment in a Course, in
the case of a Facilitator, providing Facilitation Services and, in the case of a Marker,
providing Marker Services.
Minone Pty Ltd Login means the login facility.
Minone Pty Ltd Materials means any information, documents, transcripts, data, audio
visual materials or recordings (including audio or video files of any type), or other materials
Minone Pty Ltd uploads to or displays on the Website from time to time in any form
including Course materials and Discussion Fora for the various online courses Minone Pty
Ltd makes available via the Website and Facilitator guides for Facilitators.
Audit means the random auditing by the Minone Pty Ltd in accordance with its Policies of
any Participant Submissions to determine whether the Participant Submissions are the
Participant’s own, original work.
Course means a training or certificate course using the Minone Pty Ltd Materials which
Minone Pty Ltd offers via the Website.
Discussion Fora means any online forum or tutorial provided to Participants in relation to
a Course in support of distance or online learning. Your participation in a Discussion Fora
is voluntary and your personal information (including your name, user name and location)
and comments will be visible to other Users in the relevant Discussion Fora.
Facilitation Services means the provision of services by a Facilitator in relation to
Courses including presenting Courses to Participants using the Minone Pty Ltd Materials,
on and subject to the terms of the contract between the individual Facilitator and Minone
Pty Ltd.
Facilitator means a contractor retained by Minone Pty Ltd to provide the Facilitation
Services who accesses the Website in connection with the Facilitation Services including
accessing the Minone Pty Ltd Materials and materials prepared by Minone Pty Ltd for
Facilitators to assist in delivery of the Courses.
Fees means the fees payable by a Participant for a particular Course as specified on the
Website from time to time.
Intellectual Property Rights means statutory, proprietary and all other rights throughout
the world in respect of copyright, trade marks, confidential information, patents, designs
and all other rights of a like nature, by law in force in any part of the world including all
applicable renewals and extensions.
Losses means losses, expenses, claims, proceedings, damages and costs (including
actual, special, direct, indirect, incidental, exemplary or consequential, lost profits,
business interruption, lost savings or loss of programs or other data) of every kind and
nature.
Marker means a contractor retained by Minone Pty Ltd to provide the Marker Services
who accesses the Website in connection with the Marker Services.
Marker Responses means responses by Markers to Participant Submissions including
grading results and comments, if applicable.
Marker Services means the provision of services by a Marker in relation to Courses
including marking examination responses and assignments submitted by Participants, on
and subject to the terms of the contract between the individual Marker and Minone Pty Ltd.
Participant means a person who is currently enrolled in a Course offered via the Website.
Participant Submissions means materials submitted by Participants in connection with
completing Courses including examination responses and assignments and any
comments or participation in Discussion Fora.
Personnel means Minone Pty Ltd’s officers, directors, employees, agents, contractors,
licensors and suppliers.
Policies means Minone Pty Ltd’s policies and procedures in place from time to time
including, without limitation, the Assessment Documentation from the Course information
on the OneWayLearning website and Privacy Policy.
ReadSpeaker means the text-to-speech software used by Minone Pty Ltd and the
Participants to convert Course materials and most Course Participant instructions to
speech.
Registered User means any person who has registered an Account.
Services means the offering of Courses and supply of online resources and activities via
the Website and any other services offered by us from time to time as specified on the
Website.
Third Party Applications means software and other applications used on or in respect of
the Website or the Courses and includes Turnitin.
Turnitin means the plagiarism checking software used by Minone Pty Ltd and the Markers
to minimise and detect incidents of plagiarism in Participant Submissions, and any
replacement software used by Minone Pty Ltd and the Markers from time to time.
User means any person who accesses the Website and includes Participants, Facilitators
and Markers.
Website means the website located at OneWayLearning.com.auand any other application
distribution platform (including mobile applications) through which Minone Pty Ltd provides
the Services.

1. About this policy
1.1 This privacy policy (Policy) sets out the information handling practices of Minone Pty
Ltd (Minone). It does not cover personal information about our employees (which includes
all past and present employees, but excludes applicants for a position with us, contractors
and consultants, which are covered by this Policy).
1.2 Personal information refers to information or an opinion about an identified or
reasonably identifiable individual, regardless of whether it is recorded in material form or
whether it is true or false. Sensitive information is a sub-category of personal information
and includes details about race, ethnicity, political affiliations, membership of professional
trades and associations, and health and biometric information (including any relevant
COVID-19 requirements). We will refer to sensitive information when we refer specifically
to this type of information. Where we mention personal information, this automatically
includes sensitive information.
1.3 We handle personal information in accordance with the Privacy Act 1988 (Cth)
including the Australian Privacy Principles (Privacy Act) and this Policy.
1.4 Individuals based in the European Union have rights as set out in our European Union
Privacy Policy.
2. Collection of personal information
2.1 We use the information we collect from you to deliver various products and services,
including but not limited to:
(a) contacting individuals;
(b) conducting educational and training courses;
(c) providing membership services;
(d) holding events such as webinars;
(e) providing information and services through our websites and apps as well as via email,
online advertisements and social media; and
(f) undertaking activities, either directly or through our service providers, such as surveys,
online behavioural advertising, website analytics and email campaign management.
2.2 We collect personal information for the purposes and aims stated in this Policy.
2.3 We collect personal information from our members, non-members, third parties,
service providers, suppliers, contractors, consultants, and sponsors. The nature of such
personal information varies and it is collected in different ways. More information about this
is provided below.
2.4 In some instances, you may choose to provide information about another person, for
example, the name and contact details of someone who might be interested in becoming a
member. If you provide personal information about someone other than yourself to Minone
you must make sure that they have agreed to you providing their personal information to
us. We also ask that you make them aware of this Policy, for example by giving them a link
to it.
2.5 Minone has special protections in place to keep the personal information that we
collect safe and secure. These special protections include:
(a) training our staff to keep your personal information safe and secure;
(b) putting contractual arrangements in place to protect your personal information when we
disclose it (please see section 5 for information about disclosures);
(c) implementing separate storage and technical restrictions on who can access the
personal information; and
(d) taking reasonable steps to destroy or de-identify your personal information when we no
longer require it (for example for membership or legal purposes).
2.6 If Minone does not collect your personal information, we may not be able to provide
some or all of our products and services to you. You may also find that you do not
experience the full extent of our information and products and services, including our
websites and apps.
2.7 Membership information
(a) To become a member, you must complete various membership related applications.
Such applications request a range of personal information, including name and contact
details.
(b) In some instances, you may start a membership application online without completing
it. The information that is provided on the incomplete application is also collected by
Minone and is used to contact you about becoming a member.
(c) For ongoing membership management, including requests to upgrade or renew
memberships, we collect personal information from members about:
(d) the reasons for changing their level of membership, such as proof of ill health,
parenthood, study or travel.
2.8 Information about event attendance, education and training – members and non-
members
(a) When you register your attendance at various events, including webinars conducted by
Minone , you must complete an application. Such applications may (depending on the
circumstances) request:
(i) your name, contact information and location;
(b) Minone also collects a record of all attendees at its events.
(c) During an event, the Minone may collect images and sound recordings of the event,
including of the attendees. Please refer to section 3.11 for further information about how
Minone manages the collection of images and recordings.
(d) Where you participate in a course or other training, the Minone may collect information
about your enrolment, assessment answers, course results and feedback sheets.
2.9 Survey information
(a) From time to time, Minone or its service providers may collect personal information
from survey participants, whether they are members or not. Such personal information
may include name and contact details and location.Specific surveys may collect other
types of personal information, however participation in a survey is voluntary, so if you don’t
want to provide the requested information you don't have to.
(b) We will only use the personal information collected through surveys for analytical
purposes, to assist with improvement or development of our products and services, and in
relation to external studies conducted in partnership with unrelated third parties, including
with other professional education institutes for research purposes.
2.10 Non-member information
(a) To expand the Minone’s membership, we collect information about prospective
members from existing members who might refer a prospective member to Minone , from
publicly available sources.
(b) Information about prospective members will primarily include their name, past and
present occupation, location, specific areas of interest, and contact details.
2.11 Market research findings
(a) Minone may commission market research about members as well as non-members for
various purposes, including for index surveys and feedback. If our survey provider also
collects your personal information, that survey provider will make a copy of their privacy
policy available to you, and their collection and use of your personal information will be
subject to that privacy policy.
(b) Minone only collects and holds market research information in aggregate form and
does not connect any of this aggregate information with its personal information records to
try and ascertain an individual's responses.
2.12 Images and recordings
(a) Minone collects images (video or photographs) and sound recordings of its events,
which may either be taken by Minone or by a service provider.
(b) At the time of registering for an event, you will be given the option to indicate if you do
not want Minone to collect and/or use any images or recordings of you. You may also
contact Minone directly to express your preference.
(c) Minone’s contact details are provided in section 10.
Collection of personal information from our website, emails, apps and social media
2.13 Our websites
(a) When you visit our websites or download, access or register to use our websites,
(which may also include the use of any of our products, services or apps), we may collect
your personal information such as your name, address, email address, phone number,
date of birth, username, password and other information. We may also collect information
automatically, including technical information related to your mobile device, your device’s
unique identifier, your mobile network information, the type of mobile browser you use and
information about the way you use our products, services or apps.
(b) Depending on the particular product, service or app you use, and only after you have
agreed to such collection, for example at the time of first signing up for and installing an
app, we may also collect information stored on your device, including contact information,
location information or other digital content.
(c) When you access our apps via your mobile device, our service provider collects
username details to authenticate access to member-only content. We do not review or use
this information for any purpose beyond authentication with our membership database.
(d) We or our service providers use web analytics to collect a range of information about
your interactions with our websites. Web analytics software collects the information using a
number of techniques including cookies (both first and third party cookies) and Java Script.
We also use web analytics to collect information from the browsers of those who use our
websites. Please refer to the Minone Cookie Policy or further information about cookies
and how we handle cookie data.
(e) The information we collect using web analytics software includes your IP address,
domain name, date and time of visit, the pages visited and time spent on each page,
whether you have visited the site before and what site referred you to the web page. We
use this information to evaluate the effectiveness of our websites and the level of interest
in particular pages or Minone’s campaigns.
(f) We use a variety of technology to enhance your experience, including Google Analytics,
behavioural marketing tools to build and score a profile which influences what marketing
may be of interest to you, and tools to maintain contact with members, leads and
prospects.
(g) Our websites may contain links to other sites. We are not responsible for the privacy
practices or policies of those sites and we suggest that you review the privacy policies of
those other sites.
2.14 Emails
(a) If you send us an email, that particular address will be recorded automatically by our e-
mail messaging system for the purpose of replying to your e-mail. However, if you are a
member, we will normally use the e-mail address you provided in your membership
application/renewal, unless you ask us to use a different e-mail address.
2.15 Social media
(a) We participate in social media, for example. If we think it is relevant to the quality of
service that Minone provides or its objectives, we sometimes note the nature of any topic
discussed by a particular individual and their name. Minone may then contact the
individual in a separate forum to further discuss the topic. In some instances, Minone may
keep a note of the discussion, including details about what was discussed and any
interesting insights provided by the individual, and details about when the discussion
occurred.
(b) Social media services also handle your personal information for their own purposes.
These sites have their own privacy policies. We are not responsible for the privacy
practices or policies of those sites and we suggest that you review their privacy policies.
3. Use of personal information
3.1 We will not use your personal information for any purpose which you would not
reasonably expect unless it is consistent with the Privacy Act. If we think that you may not
expect us to use your information for a purpose which is directly related to the purpose of
our collection of that information, we will ask for consent before we use it for that purpose.
Personal information from membership, training course and event applications
3.2 We use such personal information to:
(a) manage the membership of Minone and member participation in certain programs;
(b) administer and meet member requirements for the particular service, course event or
program;
(c) help us improve a particular service, event or program;
(d) identify and analyse your activities and interests to better meet member needs and
attract new members;
(e) enable us to target marketing communications to you (please refer to section 5 for
further information); and
Research findings
3.3 We use such information to:
(a) identify your needs and ensure our products and services meet those needs;
(b) identify prospective members and provide marketing approaches designed to recruit
new members; and
Event images and recordings
3.4 We use sound and image recordings of our events to promote Minone, and to enable
us to improve our events, and for educational purposes (such as webinars).
3.5 Please refer to section 3.11 for further information about how Minone
manages the collection of images and recordings.
Data aggregation
3.6 In some circumstances, we collect your personal information and de-identify it for the
purpose of aggregating data. We primarily do this to better understand certain trends
among our membership, to plan and execute marketing campaigns, to improve our
products and services, or create new ones. We may also do so for internal reporting
purposes.
3.7 We will not aggregate data for a purpose which you would not reasonably expect,
unless it is consistent with the Privacy Act. If we have any doubt about whether you would
expect us to aggregate your personal information for a certain purpose, we will seek
consent from you.
4. Communications
4.1 We may send various types of communications to you, depending on your indicated
preference.
4.2 Our advertising and marketing material, content, information and communications
(Marketing Material) is sent to you if our records indicate that you would like information
about our products and services which may be of personal and/or professional benefit to
you, whether you are a member or non-member. These products or services may extend
beyond those provided by Minone , and may include offers from third parties that we or
our providers consider may of interest to you.
4.3 Our membership-related material, content, information and communications
(Membership-Related Material) is sent to members. By signing up for membership and
providing Minone with your contact details as part of that membership application, you
consent to receiving Membership-Related Material. Membership-Related Material includes
membership welcome letters, newsletters, or any other communication which does not
involve promotion of any products or services, including those of Minone.
4.4 We may send any of these Marketing Materials or Membership-Related Materials by
mail, telephone, email, SMS or other electronic methods, such as through social media or
targeted advertising. If you indicate a preference for a method of communication, we will
try to use that method where it is practical for us to do so.
4.5 When you access our websites, we may display customised marketing material to you
based on data stored in your cookies. Your opt-out options may be different for this kind of
marketing material. Service providers we use, including remarketers, may also display our
marketing material on other parties’ websites that you visit. The display of that marketing
material may be based on your prior visits to our websites and other internet activity. We
may also use data supplied by service providers to improve our marketing material and
advertising campaigns.
4.6 We give you the chance to opt-out of receiving Marketing Material and Membership-
Related Materials in our communications with you, such as forms, letters or emails, or you
can opt out by contacting us using the details provided in section 10 or by logging-in to
your user account.
4.7 Unless you have opted out, we will continue to provide:
(a) Marketing Material and Membership-Related Material to members for 12 months after
they have ceased to be members; and
(b) Marketing Material to non-members for 12 months after their last interaction with us.
5. Disclosure of your personal information
5.1 We only disclose your personal information for the purposes outlined in this Policy or
for purposes that are directly related to those purposes that you would reasonably expect.
Events
5.2 We disclose the name of event participants to:
(a) any Presenters under strict conditions to enable them to carry out their role in relation
to an event, for example, to organise table lists, or facilitate introductions;
(b) sponsors and potential sponsors to enable them to assess whether or not to sponsor
an event;
(c) providers of special member offers from time to time under strict conditions; and
(d) event attendees in the form of a list showing the names of all the people who have
registered to attend the event, unless at the time you registered for that event that you do
not want your name included in such a list.
5.3 We also disclose the name, title, organisation, post nominal, and credentials of any
Presenters to Minone members and the public generally by way of our website to promote
the particular event.
Courses
5.4 We may disclose the name of course participants to other participants in that same
course. This is shown as a list which is displayed on the day of the course showing the
names of all the people who have registered to attend the course.
5.5 We also may disclose the name, title, organisation, post nominal, and credentials of
any Presenters to Minone members, course participants, and the public generally by way
of our websites for the purpose of promoting the particular course.

5.6 We disclose personal information to contracted service providers, including those
service providers set out under the privacy headings in our Terms and Conditions, who
assist us with a number of our functions and services including technology, data
processing, contact centre, legal, accounting, applicant verification and assessment,
business consulting, auditing, archival, delivery, banking, payments, market research,
content production and mailing but only for the purpose of fulfilling those services.
5.7 Service providers may use cookies and other technologies to conduct certain activity,
which then allows us to supply our services to you. Please refer to the Minone Cookie
Policy for further information about how we handle cookie data.
Other disclosures
5.81 We may also disclose your personal information:
(a) to other members of Minone where you have consented to us sharing that information -
for example, if a member requests your contact details, we will call or email you to ask for
your consent before sharing your details; and
Where authorised or required by law
5.82 As authorised by the Privacy Act we disclose personal information in connection with
law enforcement activities by enforcement bodies, for example other investigations into
suspected fraud or unlawful activity.
5.83 We are required by Part 2C.1 of the Corporations Act 2001 (Cth) (Corporations Act)
to collect and record certain information in our member register, and allow an individual to
inspect the Minone member register and view current and past members’ names and
addresses. Inspection is free for members, but a fee may be payable by non-members.
We will provide a copy of the register if you make a valid application under the
Corporations Act to us and pay the relevant fee. However, the Corporations Act and
Chapter 2C of the Corporations Regulations 2001 prohibit the individual from using the
information gained to contact, or send material to, members, and from using it for other
prescribed purposes and penalties apply for such misuse of such information.
5.84 We may also disclose personal information to Australian and overseas regulatory
authorities or other organisations to assist them with business licensing or due diligence
purposes. This could include the fact that you are a member of Minone , the nature of your
membership, the Minone courses you have completed, and your grades.
Overseas disclosure
5.85 From time to time, we may send your personal information overseas. Some of our
service providers are located in other countries including the US, UK and Singapore.
Where we use a service provider that hosts personal information in other countries, we
take steps that are reasonable in the circumstances to ensure that the host does not
breach the Australian Privacy Principles. The steps we take include:
(a) assessing whether the service provider is located in a country that has at least
equivalent privacy protections to those in Australia;
(b) adding provisions in our contract with the service provider that require them to protect
the personal information they hold; and
(c) when choosing a service provider, including in our considerations the privacy law or
scheme (if any) that applies in the country in which the service provider operates.
6. Security of personal information
6.1 We regularly assess the risks of misuse, interference, loss, unauthorised access,
modification or disclosure of personal information and ensure that we have adequate
measures, including policies, procedures and technology, to address those risks.
7. Retention of personal information
7.1 We hold member information for the period of 12 months.
8. Access and correction
8.1 You have a right to ask for access to the personal information we hold about you.
Unless there is a lawful reason not to, we will give you access to it and allow you to correct
any incorrect information. We may charge a fee for access (but not correction), and will
respond to your request within 30 days.
8.2 If you are a member, you can correct personal information we hold about you by
logging onto your user account, or by contacting us using the contact details below.
8.3 If you are a non-member, you can ask to correct personal information we hold about
you by contacting us using the contact details below.
8.4 We may ask you to verify your identity if you ask for access to your personal
information, or to correct your personal information, to ensure we don’t give information to
the wrong person.
8.5 If we don’t give you access to your personal information or refuse to correct it we will
tell you why.
